S tou byla proto uzav\u0159ena kupn\u00ed smlouva a uhrazena byla cel\u00e1 kupn\u00ed cena do not\u00e1\u0159sk\u00e9 \u00faschovy.<\/p>\n<p>Nejprve cht\u011bla Huserov\u00e1 nemovitosti prodat v obchodn\u00ed ve\u0159ejn\u00e9 sout\u011b\u017ei, ta ale skon\u010dila odm\u00edtnut\u00edm v\u0161ech nab\u00eddek kv\u016fli n\u00edzk\u00fdm cen\u00e1m. To bylo 9. \u00fanora 2004 a \u00fa\u010dastn\u00edci sout\u011b\u017ee, v\u010detn\u011b spole\u010dnosti GEN, o tom byli informov\u00e1ni. Vzhledem k trvaj\u00edc\u00edmu z\u00e1jmu o nemovitosti v celku n\u00e1sledn\u011b konkursn\u00ed spr\u00e1vkyn\u011b nab\u00eddla \u00fa\u010dastn\u00edk\u016fm sout\u011b\u017ee, kte\u0159\u00ed prok\u00e1zali solventnost, dal\u0161\u00ed exkluzivn\u00ed vyjedn\u00e1v\u00e1n\u00ed o cen\u011b. Ani tato jedn\u00e1n\u00ed nevedla k nab\u00eddce, kterou by v\u011b\u0159itelsk\u00fd v\u00fdbor akceptoval. Z\u00e1jem investor\u016f, nejen \u00fa\u010dastn\u00edk\u016f sout\u011b\u017ee, v\u0161ak trval d\u00e1l a proto byli vyb\u00eddnuti je\u0161t\u011b jednou k pod\u00e1n\u00ed nab\u00eddek. Nejvy\u0161\u0161\u00ed cena, co\u017e bylo jedin\u00e9 krit\u00e9rium pro z\u00edsk\u00e1n\u00ed souboru 24 nemovitost\u00ed, dos\u00e1hla 183 mili\u00f3n\u016f korun a v\u011b\u0159itel\u00e9 tuto cenu akceptovali. <\/p>\n<p>Spole\u010dnost GEN ani v sout\u011b\u017ei ani v n\u00e1sleduj\u00edc\u00edch dvou kolech vyjedn\u00e1v\u00e1n\u00ed nenab\u00eddla nejvy\u0161\u0161\u00ed cenu. P\u0159esto podala v kv\u011btnu lo\u0148sk\u00e9ho roku dv\u011b \u017ealoby. V prvn\u00ed se dom\u00e1h\u00e1 neplatnosti kupn\u00ed smlouvy mezi konkursn\u00ed spr\u00e1vkyn\u00ed a Aspana holding. V dal\u0161\u00ed \u017ealob\u011b pak po\u017eaduje, aby soud ulo\u017eil Huserov\u00e9 uzav\u0159\u00edt smlouvu o prodeji souboru nemovitost\u00ed pr\u00e1v\u011b se spole\u010dnost\u00ed G.E.N. <\/p>\n<p>A jak\u00fd to m\u011blo n\u00e1sledek? \u201eN\u011bkter\u00e9 katastr\u00e1ln\u00ed \u00fa\u0159ady p\u0159eru\u0161ily \u0159\u00edzen\u00ed o povolen\u00ed vkladu vlastnick\u00e9ho pr\u00e1va ve prosp\u011bch spole\u010dnosti Aspana Holding a\u017e do doby, ne\u017e soud o t\u011bchto \u017ealob\u00e1ch rozhodne,\u201c uvedla Huserov\u00e1. N\u00e1sledkem toho z\u016fstala cel\u00e1 kupn\u00ed cena, tedy 183 mili\u00f3n\u016f korun, v not\u00e1\u0159sk\u00e9 \u00faschov\u011b a nemohla b\u00fdt vyplacena do konkursn\u00ed podstaty. Konkursn\u00ed spr\u00e1vkyn\u011b toti\u017e vyhov\u011bla \u017e\u00e1dosti Aspana holding, aby v not\u00e1\u0159sk\u00e9 \u00faschov\u011b z\u016fstala i suma za nemovitosti, kde katastr\u00e1ln\u00ed \u00fa\u0159ady ji\u017e povolily vkladl vlastnick\u00e9ho pr\u00e1va pr\u00e1v\u011b pro Aspana holding. \u201eT\u00edm vznikla \u0161koda z rozd\u00edln\u00e9ho \u00faro\u010den\u00ed na \u00fa\u010dtu Union banky a na \u00fa\u010dtu not\u00e1\u0159sk\u00e9 \u00faschovy.
