Postup spole\u010dnosti G.E.N., kter\u00e1 se ne\u00fasp\u011b\u0161n\u011b uch\u00e1zela o soubor 24 nemovitost\u00ed, nechal nov\u00fd spr\u00e1vce prov\u011b\u0159it jako jednu z v\u011bc\u00ed, k nim\u017e se vztahuj\u00ed soudn\u00ed spory zkrachoval\u00e9 Union banky. \u201eKe zpracov\u00e1n\u00ed anal\u00fdzy jsem p\u0159istoupil vzhledem k zablokov\u00e1n\u00ed pen\u011bz za prodej nemovitost\u00ed v souvislosti se \u017ealobou podanou spole\u010dnost\u00ed G.E.N. Prodej nemovitost\u00ed byl dle dostupn\u00fdch informac\u00ed zcela v po\u0159\u00e1dku, co\u017e ostatn\u011b potvrdil sv\u00fdm usnesen\u00edm jak krajsk\u00fd tak i vrchn\u00ed soud,\u201c uvedl spr\u00e1vce.<\/p>\n<p>G.E.N. loni napadl \u017ealobou prodej nemovitost\u00ed a do\u017eaduje se, aby soud zru\u0161il kupn\u00ed smlouvu mezi Union bankou a firmou Aspana holding, kter\u00e1 za nemovitosti nab\u00eddla nejv\u00edce a tyto nakonec z\u00edskala. \u201ePo prostudov\u00e1n\u00ed v\u0161ech dokument\u016f mus\u00edm konstatovat, \u017ee v argumentech a postupu spole\u010dnosti G.E.N. je mnoho rozpor\u016f a sama si proti\u0159e\u010d\u00ed,\u201c \u0159ekl Raida.<\/p>\n<p>G.E.N. svoj\u00ed \u017ealobu mimo jin\u00e9 op\u00edr\u00e1 o tvrzen\u00ed, \u017ee nab\u00eddl nejvy\u0161\u0161\u00ed cenu v obchodn\u00ed ve\u0159ejn\u00e9 sout\u011b\u017ei na prodej nemovitost\u00ed. Sout\u011b\u017e v\u0161ak byla ukon\u010dena odm\u00edtnut\u00edm v\u0161ech nab\u00eddek, o \u010dem\u017e je po\u0159\u00edzen not\u00e1\u0159sk\u00fd z\u00e1pis z jedn\u00e1n\u00ed v\u011b\u0159itelsk\u00e9ho v\u00fdboru. Rovn\u011b\u017e sama spole\u010dnost G.E.N p\u0159i jedn\u00e1n\u00ed, ze kter\u00e9ho je k dispozici z\u00e1pis, potvrdila, \u017ee sout\u011b\u017e skon\u010dila. Tot\u00e9\u017e G.E.N. konstatoval v dopise, kde bere na v\u011bdom\u00ed ukon\u010den\u00ed sout\u011b\u017ee a kde projevil i nad\u00e1le z\u00e1jem o nemovitosti. \u201e\u0158\u00e1dn\u00e9 ukon\u010den\u00ed sout\u011b\u017ee v souladu s pravidly potvrdil i vypracovan\u00fd posudek advok\u00e1tn\u00ed kancel\u00e1\u0159e K\u0159\u00ed\u017e, B\u011blina,\u201cdoplnil konkursn\u00ed spr\u00e1vce.<\/p>\n<p>G.E.N. prost\u0159ednictv\u00edm m\u00e9di\u00ed v minul\u00fdch t\u00fddnech d\u00e1le tvrdil, \u017ee Aspana hoding z\u00edskala nemovitosti na z\u00e1klad\u011b dodate\u010dn\u011b upraven\u00e9 cenov\u00e9 nab\u00eddky, co\u017e m\u00e1 dokl\u00e1dat grafologick\u00fd posudek od znalce Pavla Koki\u0161e. Z\u00e1stupci spole\u010dnosti G.E.N. v\u0161ak z tohoto posudku nikdy necitovali dal\u0161\u00ed podstatn\u00e9 \u00fadaje, nap\u0159\u00edklad to, \u017ee nebyl zkoum\u00e1n origin\u00e1l cenov\u00e9 nab\u00eddky, ale pouze xerografick\u00e1 kopie. S\u00e1m znalec Koki\u0161 v tomto posudku uv\u00e1d\u00ed: Jeliko\u017e se jedn\u00e1 o xerografickou kopii, hodnot\u00edm spornou p\u00edsemnost jako obt\u00ed\u017en\u011bji zpracovatelnou. Znalec d\u00e1le tvrd\u00ed <a href=\"http:\/\/www.unionbanka.cz\/wp-content\/uploads\/2017\/01\/pn_01.jpg\" target=\"_blank\">(n\u00e1hled zde &gt;&gt;)<\/a>, \u017ee up\u0159esn\u011bn\u00ed z\u00e1v\u011bru zkoum\u00e1n\u00ed bude mo\u017en\u00e9 a\u017e po prozkoum\u00e1n\u00ed origin\u00e1lu. Na z\u00e1klad\u011b takto ne\u00fapln\u00fdch argument\u016f spole\u010dnost G.E.N. po\u017e\u00e1dala, aby se v\u011bc\u00ed zab\u00fdvala nejvy\u0161\u0161\u00ed st\u00e1tn\u00ed z\u00e1stupkyn\u011b.<\/p>\n<p>\u201eVzhledem k postupu spole\u010dnosti G.E.N. jsem zadal vypracov\u00e1n\u00ed grafologick\u00e9ho posudku <a href=\"http:\/\/www.unionbanka.cz\/wp-content\/uploads\/2017\/01\/pn_02_1.jpg\" target=\"_blank\">(n\u00e1hled zde &gt;&gt;)<\/a>, kter\u00fd zkoumal origin\u00e1l nab\u00eddky spole\u010dnosti Aspana holding. Z posudku vypl\u00fdv\u00e1, \u017ee s nab\u00eddkou nebylo manipulov\u00e1no mechanick\u00fdm ani chemick\u00fdm zp\u016fsobem, tedy \u017ee cenov\u00e1 nab\u00eddka nebyla dodate\u010dn\u011b upravena\u201c \u0159ekl Raida. Nov\u00fd spr\u00e1vce rovn\u011b\u017e po\u017e\u00e1dal spole\u010dnost Aspana holding o jej\u00ed vyj\u00e1d\u0159en\u00ed k p\u0159edlo\u017een\u00e9 cenov\u00e9 nab\u00eddce. Aspana holding doru\u010dila not\u00e1\u0159sky ov\u011b\u0159en\u00e9 vyj\u00e1d\u0159en\u00ed <a href=\"http:\/\/www.unionbanka.cz\/wp-content\/uploads\/2017\/01\/pn_03.jpg\" target=\"_blank\">(n\u00e1hled zde &gt;&gt;)<\/a>, ve kter\u00e9m pop\u00edr\u00e1 jak\u00e9koliv dodate\u010dn\u00e9 \u00fapravy cenov\u00e9 nab\u00eddky za soubor nemovitost\u00ed.<\/p>\n<p>V\u0161echny prostudovan\u00e9 materi\u00e1ly ukazuj\u00ed na nekorektn\u00ed postup spole\u010dnosti G.E.N., kter\u00fd by mohl ve v\u011b\u0159itel\u00edch Union banky vzbuzovat dojem, \u017ee jsou kr\u00e1ceni na sv\u00fdch pr\u00e1vech. Ve skute\u010dnosti ale postup prodeje p\u0159inesl nav\u00fd\u0161en\u00ed ceny z p\u016fvodn\u00edch 151 mili\u00f3n\u016f a\u017e na kone\u010dn\u00fdch 183 mili\u00f3n\u016f korun.<\/p>\n<p>K cel\u00e9 v\u011bci je t\u0159eba dodat, \u017ee Aspana holding \u0159\u00e1dn\u011b zaplatila za soubor nemovitost\u00ed v\u0161ech 183 mili\u00f3n\u016f korun, ale tyto pen\u00edze jsou dosud z valn\u00e9 \u010d\u00e1sti v not\u00e1\u0159sk\u00e9 \u00faschov\u011b, a to pr\u00e1v\u011b kv\u016fli \u017ealob\u011b G.E.N. \u201eV takto vznikl\u00e9 situaci, kdy kv\u016fli postupu spole\u010dnosti G.E.N. byly a jsou pen\u00edze v\u011b\u0159itel\u016f blokov\u00e1ny v not\u00e1\u0159sk\u00e9 \u00faschov\u011b, doru\u010dila dne 25.4.2005 spole\u010dnost G.E.N. Union bance p\u0159\u00edpis ozna\u010den\u00fd jako \u201eobchodn\u00ed n\u00e1vrh\u201c <a href=\"http:\/\/www.unionbanka.cz\/wp-content\/uploads\/2017\/01\/pn_04.jpg\" target=\"_blank\">(n\u00e1hled zde &gt;&gt;)<\/a>, ve kter\u00e9m nab\u00edz\u00ed sta\u017een\u00ed sv\u00e9 \u017ealoby v p\u0159\u00edpad\u011b, \u017ee j\u00ed Union banka prod\u00e1 nemovitosti v Praze a okol\u00ed,\u201c dodal Raida.<\/p>\n<p>Pokud spole\u010dnost G.E.N. dlouhodob\u011b uv\u00e1d\u011bla, \u017ee je v\u00e1\u017en\u00fdm z\u00e1jemcem o koupi souboru nemovitost\u00ed, pak je ot\u00e1zkou, pro\u010d nikdy nenab\u00eddla nejvy\u0161\u0161\u00ed cenu. Ve zru\u0161en\u00e9 sout\u011b\u017ei byla nejvy\u0161\u0161\u00ed nab\u00eddnut\u00e1 cena 151 mili\u00f3n\u016f korun, ale nikoliv od firmy G.E.N. V dal\u0161\u00edm vyjedn\u00e1vac\u00edm kole s b\u00fdval\u00fdmi \u00fa\u010dastn\u00edky sout\u011b\u017ee byla nab\u00eddnuta nejvy\u0161\u0161\u00ed cena 171 mili\u00f3n\u016f korun a op\u011bt nebyla od spole\u010dnosti G.E.N. I tuto nab\u00eddku v\u011b\u0159itelsk\u00fd v\u00fdbor odm\u00edtl jako nep\u0159im\u011b\u0159en\u011b n\u00edzkou. V posledn\u00edm vyjedn\u00e1vac\u00edm kole pak s nab\u00edzenou cenou 183 mili\u00f3n\u016f korun usp\u011bla Aspana holding a ani v tomto p\u0159\u00edpad\u011b nenab\u00eddl G.E.N. nejv\u00edce.<\/p>\n<p>V souvislosti se spole\u010dnost\u00ed G.E.N. p\u0159ipom\u00edn\u00e1me, \u017ee p\u0159edsedou jeho dozor\u010d\u00ed rady je mezin\u00e1rodn\u011b hledan\u00fd Petr Luke\u0161.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>OSTRAVA &#8211; Anal\u00fdza, kterou si nechal zpracovat nov\u00fd spr\u00e1vce konkursn\u00ed podstaty Union banky Luk\u00e1\u0161 Raida v souvislosti s medi\u00e1ln\u011b diskutovan\u00fdm prodejem nemovitost\u00ed banky, prok\u00e1zala, \u017ee se v\u011b\u0159itel\u00e9 banky nemusej\u00ed ob\u00e1vat zpochybn\u011bn\u00ed tohoto prodeje a v\u00fdnosu z n\u011bj.
